Defendant Sentenced to Prison After Threatening to Kill Tow Truck Driver Who Towed His Vehicle

Brighton, CO — Today, 17th Judicial District Attorney Brian Mason is announcing the seven-year Department of Corrections sentence for Allen Davies, 35, following his guilty plea to Attempted First-Degree Assault on May 22, 2022.  

On June 7, 2021, Allen Davies was upset that a tow truck company towed his Chevy Blazer from his home. He called the tow company and threatened to kill the driver if the vehicle was not returned. 

Davies later showed up at the tow lot and encountered a driver who was inside his truck. The victim said the defendant cut him off in a Ford Mustang and began yelling in his direction with a gun in hand. The victim wasn't even the tow driver who originally towed the defendant's vehicle. 

The defendant approached the driver and climbed onto the running board of his tow truck. Davies pressed the handgun to the victim's neck. 

The victim's cell phone rang which distracted the defendant for a just a moment. The victim sped away and eventually caused Davies to fall from the truck. As the victim attempted to leave the area in his tow truck, the defendant fired twice at his vehicle. 

The Adams County Sheriff's Office located a .40 caliber shell casing at the scene. They determined the phone used to make the threatening call and the Chevy Blazer belonged to Davies. Ultimately, the victim picked the defendant out of a photo lineup, and he was later arrested. 

On May 22, 2022, Davies pleaded guilty in Adams County District Court to the following charge: 
  • Attempted First-Degree Assault--Serious Bodily Injury with a Deadly Weapon
On June 10, 2022, an Adams County District Court Judge sentenced Davies to seven years in the Department of Corrections followed by three years of mandatory parole. 

"We will not tolerate this kind of behavior in our community," said District Attorney Brian Mason. "This defendant thought that threatening the life of a tow driver who was doing his job would somehow get his vehicle back, but in the end, all it did was earn him a stint in prison." 


Deputy District Attorney Dan Rosenberg led the prosecution of the case.
