    <title>Defendant Convicted of Adams County Murder with Another Murder Case Still Pending in Arapahoe County</title>

    <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today, District Attorney Brian Mason is announcing the First-Degree Murder conviction of Alexander Albayero, 46. An Adams County Jury returned the guilty verdict on Friday, March 4, 2022, after five days of trial. &#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;The night of December 14, 2019, into the early morning hours of December 15, 2019, Alexander Albayero and his wife attended Las Adelitas in Aurora. The victim, Juan Manuel Galindo Argumedo, was also at the nightclub that evening. At some point during the night, Galindo Argumedo, who was intoxicated, approached Albayero&#x27;s wife and potentially asked her to dance. The defendant became enraged by this and asked several employees to kick Galindo Argumedo out of the nightclub.&#xd;&#xa;&#xd;&#xa;Galindo Argumedo was eventually escorted out of the bar, but Albayero followed the victim to the parking lot. While outside, Albayero fired one shot from a .25 caliber handgun that struck Galindo Argumedo in the torso. After being shot, the victim walked a few hundred feet and collapsed. Galindo Argumedo later died at a local hospital.&#xd;&#xa;&#xd;&#xa;&#x22;This was a senseless crime, fueled by anger over a petty slight,&#x22; said District Attorney Brian Mason.&#x26;&#x23;160&#x3b; &#x22;A family has lost their loved one forever &#x26;&#x23;8211&#x3b; and the defendant will now spend the rest of his life in prison.&#x26;&#x23;160&#x3b; This was an avoidable tragedy, and the defendant is to blame.&#x22;&#xd;&#xa;&#xd;&#xa;On Friday, March 4, 2022, an Adams County Jury convicted Alexander Albayero of one count including,&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;	First-Degree Murder&#x26;&#x23;8212&#x3b;After Deliberation &#xd;&#xa;&#xd;&#xa;&#xd;&#xa;Today, Wednesday, March 9, 2022, an Adams County Judge sentenced Albayero to Life Without the Possibility of Parole in the Department of Corrections. &#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;Albayero has another First-Degree Murder case pending in Araphahoe County related to a shooting that occurred on January 3, 2020, less than three weeks after the Adams County incident. The Araphahoe County case is set for trial on June 17, 2022, and the case number is 20CR1315.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;Chief Deputy District Attorney Kristen Baker and Deputy District Attorney Sara Carty led the prosecution of this case.&#xd;&#xa;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x23; &#x23; &#x23;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;District Attorney Mason assumed the oath of office on January 12, 2021. The defendants are accused of fatally shooting and robbing Perez in Thornton on December 3, 2021. Allegedly, the defendants and the victim originally communicated on social media and agreed to meet to complete a clothing sale. The Thornton Police Department investigated the case.&#xd;&#xa;&#xd;&#xa;Garcia and McMahon&#x27;s charges include&#x3a;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;	First-Degree Murder &#x28;F1&#x29;&#xd;&#xa;	Second-Degree Murder &#x28;F2&#x29;&#xd;&#xa;	Aggravated Robbery &#x28;F3&#x29;&#xd;&#xa;	Conspiracy to Commit Aggravated Robbery &#x28;F4&#x29;&#xd;&#xa;&#xd;&#xa;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;Case numbers 2022CR000347 and 2022CR000353 were filed in Adams County District Court. Garcia&#x27;s next scheduled court appearance will be on April 8, 2022, at 1&#x3a;30pm.     <title>Former Adams County Sheriff&#x2019;s Sergeant Convicted of Sex Assault and Unlawful Sexual Contact </title>

    <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today, District Attorney Brian Mason is announcing the Sex Assault and Unlawful Sexual Contact conviction of Michael Benson, 34. An Adams County Jury returned the guilty verdicts on Monday, January 31, 2022, after six days of trial.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;In 2018, the victim, working as a civilian employee at the jail, was supervised by the defendant, former Adams County Sheriff&#x27;s Office Sergeant Michael Benson.&#x26;&#x23;160&#x3b; The victim testified that between February and July of that year, Benson spent an unusual amount of time with her at work and that his conduct included dirty jokes, flirting, and inappropriate comments in the workplace. The victim testified that the defendant became more aggressive, leading to the conduct encompassed by the charges in this case, including touching her intimate parts, forcing her to touch his penis, and ultimately digitally penetrating her.&#xd;&#xa;&#xd;&#xa;The victim testified that she was desperate to become an Adams County Sheriff&#x27;s Deputy, and she was attempting to gain entry into the academy when these incidents occurred. The victim said she was fearful that speaking out could damage her ability to become an academy cadet.&#xd;&#xa;&#xd;&#xa;ACSO Internal Affairs eventually became aware of the incidents involving the victim in this case, and members of the IA team contacted her in September of 2018. Benson was terminated by the Sheriff&#x27;s Office. The criminal case was investigated by the Commerce City and Brighton Sexual Assault Task Force.&#x26;&#x23;160&#x3b;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;&#x22;Mr. Benson used his position of power to force himself upon a subordinate and sexually assault her,&#x22; said District Attorney Brian Mason. &#x22;Such a crime is outrageous on its face, but it is particularly reprehensible coming from a Sheriff&#x27;s Deputy. We will not tolerate this behavior. My office will prosecute those who commit these crimes without fear or favor, including when it occurs in a jail by a member of law enforcement. I applaud the victim for her courage in coming forward and am grateful to the jury for returning a just verdict.&#x22;&#xd;&#xa;&#xd;&#xa;On Monday, January 31, 2022, an Adams County Jury convicted Michael Benson of three counts including,&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;	Sex Assault&#x26;&#x23;8212&#x3b;Overcome Victim&#x27;s Will &#x28;F4&#x29;&#xd;&#xa;	Unlawful Sexual Contact&#x26;&#x23;8212&#x3b;&#x28;M1&#x29; &#x28;2 counts&#x29;&#xd;&#xa;&#xd;&#xa;&#xd;&#xa;Benson will be sentenced on April 7, 2022, at 9&#x3a;00am.&#x26;&#x23;160&#x3b;Chief Deputy District Attorney Stephanie Fritts and Chief Deputy District Attorney Rhoda Pilmer led the prosecution of this case.&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x23; &#x23; &#x23;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;District Attorney Mason assumed the oath of office on January 12, 2021.     <title>Defendant Who Shot and Killed Two People Outside of a Westminster Bar Convicted of First-Degree Murder</title>

    <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today, District Attorney Brian Mason is announcing the First-Degree Murder conviction of Steven Muniz, 40. An Adams County Jury returned multiple guilty verdicts on Thursday, December 23, 2021, after nine days of trial.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;On March 5, 2021, Stephen Muniz attended Sportswatch Bar and Grill along Lowell Boulevard in Westminster with family, friends, and members of the gang he is a self-admitted member of. At some point during the evening, the group that Muniz was with became embroiled in a confrontation with another group of individuals at the bar. The altercation became physical when Muniz punched one of the people from the other group, but it ended a short time later.&#xd;&#xa;&#xd;&#xa;In the early morning hours of March 6, 2021, individuals began to leave the bar, including Keith Ames, 33, who was one of the men involved in the confrontation earlier in the night. As Ames left the bar, Muniz followed behind. As they reached the parking lot, Muniz confronted Ames. At some point during this additional confrontation, Muniz fired four shots from a 9mm handgun, two of which struck Ames in the back. He was later pronounced deceased. The other two shots struck Jessica Ybarra, 31, in the foot and back as she stood in the parking lot nearby. She also died as a result of the shooting.&#xd;&#xa;&#xd;&#xa;After firing the four shots that killed Ames and Ybarra, Muniz fled on foot and jumped in the truck of a friend, Robert Manzanares. The two drove away from the scene.     <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today, District Attorney Brian Mason is announcing the 25-year prison sentence for Theodore Hrdlicka, 51, following his guilty plea to Attempted Murder on September 8, 2021.&#xd;&#xa;&#xd;&#xa;On August 5, 2019, a vehicle containing a grandfather, his son, and his young grandson were traveling along Highway 36 in Adams County toward Estes Park. They were on a family camping trip from out of state when they noticed an individual driving recklessly and traveling in their direction. They heard gunshots as the truck approached their vehicle.&#xd;&#xa;&#xd;&#xa;Moments later, the driver, Courtney Hrdlicka, 32, pulled up alongside their car while her husband, Theodore Hrdlicka, stuck his gun out of the passenger-side window and opened fire. Several bullets struck the victim&#x27;s vehicle including one that was inches away from striking the young boy. He was left covered in metal fragments from the shooting.&#xd;&#xa;&#xd;&#xa;The Hrdlicka&#x27;s continued on, and Theodore proceeded to fire additional rounds from his weapon. Two other vehicles were struck during this incident. The Hrdlicka&#x27;s fled the area and were later arrested at a home in unincorporated Adams County.&#xd;&#xa;&#xd;&#xa;It was later determined the Hrdlicka&#x27;s allegedly committed an identical series of crimes in Arapahoe County shortly before the shooting in Adams County. Earlier this year, Courtney Hrdlicka pleaded guilty to Accessory to a Crime in Adams County and First-Degree Assault with a Deadly Weapon in Arapahoe County. She was sentenced to a total of 10 years in the Department of Corrections.     <title>Defendant Convicted of Attempted Murder for Stabbing Man During Fatal 2014 Aurora Bar Fight </title>

    <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today District Attorney Brian Mason is announcing the Attempted Murder conviction of Bryant Montoya, 27. An Adams County Jury returned a guilty verdict on Wednesday, August 11, 2021, after a three-day jury trial.&#xd;&#xa;&#xd;&#xa;On November 21, 2014, Bryant Montoya and Ignacio Luque-Verdugo, 37, were inside the Bronco Bar on East Montview Boulevard in Aurora. At 12&#x3a;42am, Luque-Verdugo and Montoya engaged in a verbal and physical altercation with a group of men who were also inside the bar. The dispute appeared to center around an issue with a beer. At some point during the physical portion of the fight, Montoya stabbed Andres Cinto-Duran, 28, multiple times in the shoulder and back. Luque-Verdugo proceeded to brandish a firearm and discharged the weapon multiple times. Andres Cinto-Duran was struck in the torso, leg, and arms and was later pronounced dead at a local hospital. Cinto-Duran&#x27;s brother was also struck and paralyzed as a result of the shooting. A third man was hit in the leg by gunfire, but he survived the shooting.&#xd;&#xa;&#xd;&#xa;Montoya and Luque Verdugo left the bar after the shooting and assaulted a man outside. The two then fled the scene. Luque-Verdugo was arrested on July 13, 2015, and convicted of first-degree murder and related charges on April 14, 2017. Luque-Verdugo is now serving a life sentence in the Department of Corrections. Montoya was arrested on August 22, 2017, on felony drug charges in Arizona. His DNA was matched to the case in Aurora and he was subsequently charged for his role in the 2014 bar fight.&#xd;&#xa;&#xd;&#xa;&#x22;I am pleased that both of the men who wreaked havoc on these innocent Aurora bar patrons in 2014 have now been brought to justice,&#x22; said District Attorney Brian Mason. &#x22;The actions of these two defendants ended the life of one man and forever altered the life of his brother. I want to personally thank the Aurora Police Department and its detectives for their years-long commitment to this case as well as to the jurors for delivering a just verdict.&#x22;&#xd;&#xa;&#xd;&#xa;On Wednesday, August 11, 2021, an Adams County Jury convicted Bryant Montoya of four counts including,&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;	Second-Degree Murder-Attempted &#xd;&#xa;	Second-Degree Assault&#xd;&#xa;	Accessory to a Crime &#xd;&#xa;	Third-Degree Assault&#xd;&#xa;&#xd;&#xa;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;Montoya will be sentenced on September 17, 2021, at 1&#x3a;30pm before Judge Priscilla Loew.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;Deputy District Attorney Troy Moyer led the prosecution of Mr. Montoya&#x27;s case.     <description>Brighton, CO &#x26;&#x23;8212&#x3b;Today, District Attorney Brian Mason is announcing the Vehicular Homicide conviction of Bryan Kirby, 24. An Adams County Jury reached its verdict on Thursday, July 15, 2021, after four days of trial.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;On October 13, 2018, Bryan Kirby was live streaming to his Facebook account while driving along E470. During the live stream, the vehicle&#x27;s speed fluctuated between 120 and 150 miles per hour. At one point, Kirby accelerated to 167 miles per hour, addressed the live stream, and said, &#x22;we cruise at 140.&#x22;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;Kirby continued to drive at speeds between 140 and 155 miles per hour while making comments to the viewers on the live stream about the speed at which he was driving. Near the end of the live stream, Kirby accelerated from 117 miles per hour to 120 miles per hour. A dark-colored sedan was driving in the right lane. Kirby rapidly approached the sedan from the left, crossed over the center lane markings, and struck the rear of the other vehicle while traveling at approximately 120 miles per hour. A loud crunching noise could be heard in the live stream as the phone appeared to tumble around the interior of the vehicle, and the video abruptly stopped. Following the crash, Kirby fled the area and the victim was pronounced dead at the scene.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;&#x22;The incredibly reckless actions of this defendant caused the death of an innocent victim,&#x22; said District Attorney Brian Mason. &#x22;He not only acted in a manner that ultimately caused someone&#x27;s death, he live-streamed it on social media for the world to see. This death was preventable. Recklessly driving at an outrageous speed and live streaming at the same time is not acceptable in this community.     <description>Brighton, CO &#x26;&#x23;8212&#x3b; Today, 17th Judicial District Attorney Brian Mason is announcing the 18-year prison sentence for Mario&#x26;&#x23;160&#x3b;Diaz-Miranda, 28, following his guilty plea on May 11, 2021, to Distribution of a Controlled Substance &#x28;DF1&#x29;.&#xd;&#xa;&#xd;&#xa;On January 8, 2021, following a lengthy surveillance operation, investigators with the North Metro Drug Task Force&#x26;&#x23;160&#x3b;arranged to buy two kilograms of cocaine from Mario Diaz-Miranda in Thornton. The purchase was completed in a&#x26;&#x23;160&#x3b;parking lot and Diaz-Miranda was arrested shortly thereafter. Investigators found cocaine inside of Diaz-Miranda&#x27;s&#x26;&#x23;160&#x3b;vehicle and an additional 48 kilograms were located inside of a wall of an apartment associated with the defendant. In&#x26;&#x23;160&#x3b;total, &#x24;2.1 million worth of cocaine was seized as a result of this investigation.&#xd;&#xa;&#xd;&#xa;On May 11, 2021, Diaz-Miranda pleaded guilty to Distribution of a Controlled Substance &#x28;DF1&#x29;. On June 29, 2021, the&#x26;&#x23;160&#x3b;defendant was sentenced to 18 years in the Department of Corrections followed by three years of parole.&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x22;This was an extraordinary amount of drugs to get off our streets,&#x22; said District Attorney Brian Mason. &#x22;Drug&#x26;&#x23;160&#x3b;traffickers pose a significant danger to this community and we&#x27;re working tirelessly to combat them. Mason announced the First-Degree&#x26;&#x23;160&#x3b;Murder conviction of John Swenson, 25. An Adams County jury convicted Mr. Swenson after four days of&#x26;&#x23;160&#x3b;trial. He will be sentenced on May 10, 2021, at 1&#x3a;00 pm.&#xd;&#xa;&#xd;&#xa;On December 9, 2019, the Westminster Police Department was called to an apartment at a senior&#x26;&#x23;160&#x3b;housing center located along 68th Avenue. The caller phoned in a welfare check after growing concerned&#x26;&#x23;160&#x3b;because she had been unable to reach her mother for several days. When officers arrived at the&#x26;&#x23;160&#x3b;apartment, they found Linda Shomberg, 75, lying on the floor. The victim was bleeding from her head&#x26;&#x23;160&#x3b;and was unresponsive. Shomberg was transported to a local hospital where she later died. The victim&#x26;&#x23;160&#x3b;sustained severe injuries to her face, skull, and brain as a result of significant blunt-force trauma.&#x26;&#x23;160&#x3b;Shomberg&#x27;s grandson, John Swenson, was charged with first degree murder in the case.&#xd;&#xa;&#xd;&#xa;&#x22;This brutal crime shocks the conscience,&#x22; said District Attorney Brian Mason. &#x22;The defendant&#x27;s&#x26;&#x23;160&#x3b;brutality against his own grandmother was truly unspeakable. I appreciate the jury returning a just&#x26;&#x23;160&#x3b;verdict in this case.&#x22;&#xd;&#xa;&#xd;&#xa;Mr. Swenson had been staying with his grandmother following his removal from a halfway house.&#x26;&#x23;160&#x3b;Shomberg&#x27;s neighbors reported to police that on December 6, 2019, three days before the victim&#x27;s body&#x26;&#x23;160&#x3b;was discovered, they continuously heard loud, pounding noises emanating from her apartment. Some of&#x26;&#x23;160&#x3b;the neighbors reported that the sound persisted anywhere from three to seven minutes. Through the&#x26;&#x23;160&#x3b;course of the investigation it was determined that Swenson brutally battered his grandmother as a&#x26;&#x23;160&#x3b;result of her expressed displeasure in his life choices. The medical examiner concluded the victim&#x26;&#x23;160&#x3b;suffered a stroke and the assault and blunt-force trauma to her head contributed to her death.&#xd;&#xa;&#xd;&#xa;On April 29, 2021, an Adams County jury convicted John Swenson of FIRST-DEGREE MURDER. The&#x26;&#x23;160&#x3b;defendant will be sentenced on May 10, 2021, at 1&#x3a;00 pm. Deputy District Attorney Ashley Wiener and&#x26;&#x23;160&#x3b;Senior Deputy District Attorney Shelby Fyles led the prosecution of this case.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;&#x23;&#x23;&#x23;&#xd;&#xa;&#xd;&#xa;District Attorney Mason assumed the oath of office on January 12, 2021. Mason announced the First-Degree&#x26;&#x23;160&#x3b;Murder conviction and life sentence of Ricardo Munoz-Diaz, 33. A Broomfield County jury convicted Mr.&#x26;&#x23;160&#x3b;Munoz-Diaz on Friday, April 23, 2021, of First-Degree Felony Murder, Second Degree Murder, Aggravated Robbery-Wound or Strike, Aggravated Robbery, and two counts of Second-Degree Burglary after a five-day trial. The defendant was sentenced to life without parole at a sentencing hearing today.&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x22;My heart truly breaks for this victim as well as her children, who are now left without a mother,&#x22; said&#x26;&#x23;160&#x3b;District Attorney Brian Mason. &#x22;I cannot imagine the overwhelming fear she felt as she struggled for&#x26;&#x23;160&#x3b;her life that horrible day.&#x22;&#xd;&#xa;&#xd;&#xa;&#x22;Although it took six years to secure justice because of the defendant&#x27;s flight, I am grateful that justice&#x26;&#x23;160&#x3b;was finally served. The defendant was motivated by money and greed and then fled from authorities&#x26;&#x23;160&#x3b;after perpetrating this terrible crime. I appreciate the effort that went into extraditing Mr. MunozDiaz back from his hiding place in Mexico. And I appreciate the hard work of the prosecution team&#x26;&#x23;160&#x3b;that led to this important verdict.&#x22;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;On October 11, 2015, Ricardo Munoz-Diaz broke into the home of Amalia Karolina Lopez-Leon, 33, along&#x26;&#x23;160&#x3b;E. Midway Boulevard in Broomfield, Colorado. Lopez-Leon was not home at the time of the initial break-in. Munoz-Diaz entered the victim&#x27;s home through a back door in an attempt to steal money from inside&#x26;&#x23;160&#x3b;a safe in her residence. However, Munoz-Diaz was unable to open the safe and subsequently departed&#x26;&#x23;160&#x3b;Lopez-Leon&#x27;s home. Munoz-Diaz previously lived in the same mobile home park as the victim and had&#x26;&#x23;160&#x3b;come under the belief that she kept a large amount of cash in the safe.&#xd;&#xa;&#xd;&#xa;On October 18, 2015, Munoz-Diaz returned to Lopez-Leon&#x27;s home to steal the contents inside the safe.&#x26;&#x23;160&#x3b;Lopez-Leon was present when Munoz-Diaz arrived. The defendant made his way inside through the&#x26;&#x23;160&#x3b;front door and immediately brandished a BB gun. He commanded the victim to open the safe, but&#x26;&#x23;160&#x3b;Lopez-Leon was unable to do so. Munoz-Diaz proceeded to choke the victim and beat her with his BB gun.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;During the struggle, Lopez-Leon made it to the kitchen where she was able to obtain a knife to defend&#x26;&#x23;160&#x3b;herself. However, Munoz-Diaz stripped it away from her and stabbed the victim eight times in the chest&#x26;&#x23;160&#x3b;and torso. Lopez-Leon fell to the kitchen floor where she later died. The victim suffered significant blunt-force trauma as well as stab wounds as deep as seven inches to her lungs, heart, liver, and stomach.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;Munoz-Diaz departed the residence after he killed Lopez-Leon. The defendant returned later to collect&#x26;&#x23;160&#x3b;the safe. Munoz-Diaz drove to a nearby lake and opened the safe. He discovered there was no money&#x26;&#x23;160&#x3b;inside, only miscellaneous papers and documents, so he dumped the safe in the water and left the area.&#x26;&#x23;160&#x3b;Munoz-Diaz also stole a purse and two watches from Lopez-Leon&#x27;s home. The defendant pawned the&#x26;&#x23;160&#x3b;watches before departing to Mexico to hide out with his parents. Munoz-Diaz was eventually extradited&#x26;&#x23;160&#x3b;back to Broomfield County in 2019.&#xd;&#xa;&#xd;&#xa;On April 23, 2021, a Broomfield County jury convicted Ricardo Munoz-Diaz of FIRST-DEGREE FELONY&#x26;&#x23;160&#x3b;MURDER, SECOND-DEGREE MURDER, AGGRAVATED ROBBERY-WOUND OR STRIKE, AGGRAVATED&#x26;&#x23;160&#x3b;ROBBERY-KILL, MAIM, OR WOUND, and &#x28;2&#x29; two counts of SECOND-DEGREE BURGLARY. Munoz-Diaz was sentenced to life without parole for First-Degree Murder, 24 years for Second-Degree Murder, 12 years&#x26;&#x23;160&#x3b;for Aggravated Robbery-Wound or Strike, 18 years for Aggravated Robbery-Kill, Maim, or Wound, 12&#x26;&#x23;160&#x3b;years for Burglary &#x28;Count 1&#x29;, and 12 years for Burglary &#x28;Count 2&#x29;. All of the sentences will run concurrently&#x26;&#x23;160&#x3b;with the life without parole sentence. Chief Deputy District Attorney Rhoda Pilmer and Senior Deputy&#x26;&#x23;160&#x3b;District Attorney Amy Petri-Beard led the prosecution of this case.&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#xd;&#xa;&#x23;&#x23;&#x23;&#xd;&#xa;&#xd;&#xa;District Attorney Mason assumed the oath of office on January 12, 2021.     <description>&#x22;I am grateful to the jury in Minnesota for calling the death of George Floyd exactly what it was&#x3a;&#x26;&#x23;160&#x3b;murder. I am also grateful to the law enforcement officers who took the stand and testified that the&#x26;&#x23;160&#x3b;defendant&#x27;s conduct was not policing, it was a crime. It takes courage to do the right thing and that is&#x26;&#x23;160&#x3b;what the jury and police witnesses did. Their service to their community is also a service to ours.&#xd;&#xa;&#xd;&#xa;&#x26;&#x23;160&#x3b;I applaud the prosecution team for their professionalism in presenting this case as well. Their&#x26;&#x23;160&#x3b;outstanding work is an example to which all prosecutors should aspire.&#x26;&#x23;160&#x3b;This murder conviction is an important step, but is only a step. The work of addressing racial disparities&#x26;&#x23;160&#x3b;in our criminal justice system should and must continue. Since George Floyd&#x27;s murder, we have engaged&#x26;&#x23;160&#x3b;in a serious, difficult and often painful conversation about race, policing and the criminal justice system.&#x26;&#x23;160&#x3b;We cannot become complacent because this case ended with the appropriate result. Mason announced the First-Degree&#x26;&#x23;160&#x3b;Murder conviction of Russell Montoya, Jr., 39. An Adams County jury convicted Mr. Montoya of FirstDegree Murder and Tampering with a Deceased Human Body on Thursday after a four-day trial.&#xd;&#xa;&#xd;&#xa;On November 8, 2019, Shane Nelson, 38, visited the home of his childhood friend, Russell Montoya, Jr.in unincorporated Adams County. During a verbal altercation, Montoya brandished a handgun and fired&#x26;&#x23;160&#x3b;four shots over the course of approximately 12 seconds. Two of the shots struck Nelson in the chest and&#x26;&#x23;160&#x3b;one in the head. Nelson fell to the kitchen floor where he later died.&#xd;&#xa;&#xd;&#xa;In the days following Nelson&#x27;s death, Montoya pieced together a plan to dispose of the victim&#x27;s body.&#x26;&#x23;160&#x3b;Montoya purchased materials at a local hardware store and then created a makeshift tomb under the&#x26;&#x23;160&#x3b;stairs of his unfinished basement. Ultimately, Montoya fully encased Nelson&#x27;s body in concrete and&#x26;&#x23;160&#x3b;attempted to mask the odor that emanated from the area.&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;&#x22;The gruesome nature of this crime is beyond words,&#x22; said District Attorney Brian Mason. &#x22;I&#x27;m&#x26;&#x23;160&#x3b;grateful to the jury for enduring through the presentation of the evidence and for returning a just&#x26;&#x23;160&#x3b;verdict.&#x22;&#xd;&#xa;&#x26;&#x23;160&#x3b;&#xd;&#xa;On November 13, 2019, Montoya confessed to one of his daughters when she expressed suspicions&#x26;&#x23;160&#x3b;about his behavior and the conditions of his home. The daughter notified the Adams County Sheriff&#x27;s&#x26;&#x23;160&#x3b;Office, and the SWAT team executed a search warrant at Montoya&#x27;s home on November 14, 2019.&#x26;&#x23;160&#x3b;Montoya was arrested and the tomb containing Nelson&#x27;s body was discovered.&#xd;&#xa;&#xd;&#xa;On April 15, 2021, an Adams County jury convicted Russell Montoya, Jr. of FIRST-DEGREE MURDER and&#x26;&#x23;160&#x3b;TAMPERING WITH A DECEASED HUMAN BODY. Montoya received a life sentence without the possibility&#x26;&#x23;160&#x3b;of parole for the first-degree murder charge and a 12-year sentence for tampering with a deceased&#x26;&#x23;160&#x3b;human body charge.
