17th Judicial District Attorney’s Office Charges Aaron Aguirre-Garay With Child Abuse Resulting in Death

Brighton, CO – The District Attorney’s Office announced today the filing of criminal charges against Aaron Aguirre-Garay, 40, related to a fatal crash that caused the death of a child in Commerce City on I-76 and U.S. 85 on February 12, 2026. 

Aguirre-Garay is charged with: 

  • Child Abuse Resulting in Death (F2)
  • Vehicular Homicide -- DUI (F3)
  • Vehicular Homicide -- Reckless (F4)
Case number 2026CR000463 was filed in Adams County District Court. Aguirre-Garay's next court appearance is on March 9, 2026, 9:00am in Division 7. 

The filing of a criminal charge is merely a formal accusation that an individual(s) committed offense(s) under Colorado laws. A defendant is presumed innocent until and unless proven guilty. See Colo RPC 3.6.
