17th Judicial District Attorney’s Office Files Charges Against Defendants in Quality Inn Shooting


Brighton, CO —Today, the 17th Judicial District Attorney’s Office is announcing the filing of charges against Rafael Martinez, 18, Rizvan Rastogor, 17, Damien Lucero, 17, and a fourth individual who is a juvenile and cannot be identified due to the individual's age and charges filed against them. The defendants are charged for their alleged conduct during a fatal shooting that occurred at the Quality Inn and Suites on Ouray Street in Aurora on March 9, 2022.

Rafael Martinez:
  • First-Degree Murder (F1)
  • Criminal Attempt to Commit Murder in the First Degree (F2) (3 Counts)
Rizvan Rastogor:
 
  • First-Degree Murder (F1)
  • Criminal Attempt to Commit Murder in the First Degree (F2) (3 Counts)
  • Possession of a Handgun by a Juvenile (M2)
Damien Lucero:
 
  • First-Degree Murder (F1)
  • Criminal Attempt to Commit Murder in the First Degree (F2) (3 Counts)
  • Possession of a Handgun by a Juvenile (M2)
Unnamed Juvenile:
 
  • Accessory to a Crime (F4)
  • Possession of a Handgun by a Juvenile (M2)
 
Case numbers 2022CR000822, 2022CR000846, and 2022CR000840 were filed in Adams County District Court. Martinez’s next court appearance is on March 29, 2022, at 8:30am in Division Q. Rastogor and Lucero’s next court appearances are on March 31, 2022, at 8:30am in Division Q.

The filing of a criminal charge is merely a formal accusation that an individual(s) committed a crime(s) under Colorado laws. A defendant is presumed innocent until and unless proven guilty. See Colo RPC 3.6.
