17th Judicial District Attorney's Office Files First-Degree Murder, Various Other Charges Against James Benavidez

Brighton, CO – The District Attorney’s Office announced today the filing of a First-Degree Murder charge and various other charges against James Benavidez, 50, for a series of alleged criminal actions that occurred in Brighton and Adams County on August 28, 2025. 

Benavidez is charged with: 

  • First-Degree Murder (F1)
  • First-Degree Attempted Murder (F2) (8 Counts)
  • First-Degree Unlawful Termination of a Pregnancy (F3)
  • First-Degree Assault (F3) (6 Counts)
  • First-Degree Motor Vehicle Theft (F3) (2 Counts)
  • Attempted Aggravated Robbery (F4) (3 Counts)
  • Second-Degree Assault (F4)
  • Vehicular Eluding (F5)
  • Possession of a Weapon by a Previous Offender (F5)
  • Crime of Violence (SE) (2 Counts)

The offenses were all filed under case number 2025CR2490 in Adams County District Court. Benavidez's next court appearance is on September 8, 2025, at 8:30am. 

The filing of a criminal charge is merely a formal accusation that an individual(s) committed offense(s) under Colorado laws. A defendant is presumed innocent until and unless proven guilty. See Colo RPC 3.6.
